Commission

The client is to read and understand the terms before purchasing a commission from the artist. If you reach out to the artist for a commission it will be automatically assumed the Terms of Service have been read and understood.By sending payment, you have acknowledged that you have read, understood, and agreed to following the current Terms of Service.Breaching the terms of service will result in cancellation of the Client’s current order(s), a possible ban from future commission work, and legal action where applicable.The Terms of Service are subject to changes without alert to current or future clients. Please make sure to read prior to every commission. The terms that were active during the clients commission period will be the terms they are to follow.

Commission Consent

Listed below is what the artist consents and refuses to doing commission work of. Either list is subject to growth as the artist discovers more things they are or are not comfortable doing art of. It is at the artist's discretion if they will or will not attempt anything that is not listed within the current Terms of Service.Any commission requests that the artists receive that include content the artist will not draw will automatically be denied. A reason may be given by the artist at their discretion.If a client repeatedly attempts to breach the artist's consent they are subject to being black-listed from all future commission work. Breaching this Term of Service may result in being blocked from future communication entirely.Consent to Draw:

Any form of artwork that could be seen as racist, xenophobic, homophobic, transphobic, or any form of hate against a group of people.

General Info

By commissioning yamilink (the Artist), the client is paying for artistic labor only (a service). The Client does not receive rights to reuse, publish, edit, or sell the artwork being created unless copyright has been purchased. However AI has zero exception, and will not be used in any sort of way to generate new work or used to finish the paid work.
By purchasing a commission, a client attests to being over 18 years old or older.
The client is to provide a physical representation of their character for any commission type that is not a Custom Design. The artist does not work from text based descriptions.
The artist reserves the right to reject any commission for any reason.
The artist reserves the right to cancel any commission at any point for any reason.

Communication,
Deadlines, Delivery

The artist can be contacted via private message by email at [email protected]. During the ordering process, the client and artist will agree upon a preferred communication platform.
Deadlines, if not explicitly stated in the commission offering, must be requested, and agreed upon prior to payment. The artist reserves the right to decline deadlines mentioned after the commission has been paid for.
The turnaround time for commissions is not yet measured but expected to be 1 to 3 months on average. The Artist may finish the commission faster or slower depending on the commission type, technical problems, long queue, vacation, etc.
The artist will update the client on the progress of their commission, and seek approval whenever relevant, by sending low resolution work-in-progress (WIP) images of the artwork in its current phase of production.
Client may request WIPs at any time with a reasonable cadence (once weekly) and with the understanding that there may have been no progress since the previous WIP, especially if there is not an agreed-upon deadline.
Completed artwork will be sent via email to the client.
Unless otherwise specified in the commission offering, the completed artwork will be a digital illustration and a physical copy will not be shipped to the Client. The Artist does not provide a PSD (or other layered file type) or unwatermarked version of the completed artwork to the Client.

Payments and Refunds

Payments for commissions will be paid via PayPal through an invoice to the client.
All prices and PayPal invoices are listed and to be paid in USD.
Completion of payments does not guarantee the artist will instantly work on the commission.
Payment plans are at the discretion of the artist.
After a month of non-payment for the original invoice the artist will cancel the invoice and the client will lose their commission and lose their place in the artist's queue. The client will have to re-hire the artist to regain a place in their queue.
The client will not send any unsolicited PayPal payment directly to the Artist. Any random payment sent to the artist’s PayPal without permission will be refunded, minus any fees deducted by PayPal.
The artist will complete the commission in stages in accordance with the payment. If there is no payment plan the commission will not begin until payment has been completed.
For payment plans, the stages of completion will be based upon how much of the commission has been paid. 50% payment will result in completion of the sketch and planning phase. 75% payment will result in completion of the sketch and lining phase. Once 100% of payment has been reached the artist will complete and finalize the commission.
The client may request a cancellation of the commission any time before the start of the commission.
Once the artist has started the commission, there will be no full refund of the commission. Refund will be based upon the time the artist has spent on the commission.
If the client requests a refund in the sketch stage of their commission they may receive up to a 75% refund of the original commission price.
If the client requests a refund in the lining stage of their commission they may receive up to a 50% refund of the original commission price.
If the client requests a refund in the coloring stage of their commission they may receive up to a 25% refund.
Once the artist is passed the coloring stage there will be no refunds granted by the artist to the client. The artist will complete the commission as originally ordered.
The client is not entitled to any form of refund once the commission is completed.
This is a no AI artist. Provided WIPs (Works in Progress) and finished pieces are not to be used for AI to generate or complete the commission with and without the artist's permission. Failure to comply with this ToS will result in legal action and zero refund.

Commission Stages

A commission is typically done and sent for approval during multiple stages of their completion. The artist will send work in progress shots as they feel are necessary to request approval, as well as, to show progress on the clients commission.After each stage there is a approval request based on the artists discretion.Some commission types may vary on their stages. It's at the artists discretion of what stages they need and request approval for.Stage 1: Initial Sketch
